When judgment can be obtained?

In the event that the plaintiff succeeds in his application for summary judgment, or for striking out the defence, then judgment may be entered against the defendant.

In the event that the plaintiff is not successful, he would have to prove his claim on the balance of probabilities at the full trial, and if he succeeds thereafter, judgment would be given in his favour.

The Evidence Act 1950 applies to all proceedings with respect to the admissibility of evidence in the courts.
