What are the restrictions for foreign employment? |
|
All foreign personnel desirous of exercising employment in Malaysia are required to obtain employment permits which are issued subject to the following guidelines: · A company with foreign paid up capital of USD 2 million (RM7.6 million) can
be considered for 5
expatriate posts including key posts. Additional expatriate posts can
be considered on request. · A company with foreign paid up capital of less than USD2 million (RM7.6 million) can be considered for expatriate posts on the following basis:
- expatriates in executive positions which require professional qualifications and practical experience not readily available in Malaysia may only be employed for a maximum period of 10 years, subject tot he condition that Malaysians are trained to take over eventually;
- expatriates in non-executive positions which required technical skills and experience may only be employed for a maximum period of 5 years, subject to the condition that Malaysians are trained to take over eventually;
- companies with foreign paid up capital of at least RM500,000 may be allowed key posts depending on the merits of each case. These
guidelines may be relaxed for designated priority industries depending upon the merits of
each case. The employment of Malaysian nationals at all levels should, wherever possible, reflect the multi-racial composition of the country. |
