Can the conditions of employment be stated in the application? |
Yes. A employer can state his conditions of employment in the employment application.
The prospective employee who signs the application acknowledges his consent to these conditions.
Some of these conditions include the employers explicitly right to terminate the employee at will.
These conditions are very useful for the employer to protect himself in the event that the employee misrepresents something on an employment application. This may provide an employer with a good evidence to defend any unnecessary claims made by employees.
It may be appropriate for the employer to make the application form into an "acknowledgement of waiver" form by including the following at the bottom of the application form:

"I agree to conform to the rules and regulations of the company and acknowledge that these rules and regulations may be changed, interpreted, withdrawn or added to by your company at any time and from time to time, at the company's sole option and without any prior notice to me. I further acknowledge that my employment may be terminated, and any offer of employment, if such is made, may be withdrawn, with or without cause, and with or without prior notice, at any time, at the option of the company or myself" |
