It depends. If you have violate a fundamental breach in the employment contract, for example, have committed a serious offence, absence without leave, destroy companys properties or uncalled behaviour, you can be fired immediately. In most cases, the employer must give to sufficient notice as stated in your employment contract before he can fire you. |
Can an employer fire a worker who refuses to work during his off day or public holiday? |
If there are no employment contracts or union contracts between the employer and the employee, the employer will have a upper hand to fire the employees at will for any legal reasons or no reason at all. If there is an employment contract or a union, the situation is different. Most bosses do not fire their employees as they like. This can bring low morale to the whole organisation. Moreover, most large companies have rules that their local managers are told to comply with, that are designed to prevent arbitrary firings as senior management know that it is bad for business in the long term. However, if an employee is consistently insubordinating his employer, ten it gives the employer ample ground to fire the employee. An employer has to look after the needs of the business first. If there is a real need for the employee to come back to work eventhough it is his scheduled day off or public holiday (for example, attending to Y2Ks problems, emergency breakdown of machines) and there is no real hardship or very strong reason why the employee could not shift his schedule, the employee is bound to be fired for insubordination. |
